2026:JHHC:8178 -: 1 :- IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 11369 of 2025 Ranjeet Bharti @ Ranjeet Kumar son of Raju Bharti @ Raju Bhuiyan, resident of Village Auru, PO Arugeruwa, Police Station Hunterganj, District Chatra. … … Petitioner Versus The State of Jharkhand … … Opposite Party ---- CORAM : SRI ANANDA SEN, J. ---- For the Petitioner: Mr. Abhay Kumar Chaturvedy, Advocate For the State: Mr. Sanat Kumar Jha, A.P.P. ---- 04/23.03.2026 Heard learned counsel for the petitioner and learned A.P.P. appearing for the State. 2. By way of this bail application, the petitioner prays for grant of regular bail in connection with Hunterganj Police Station Case No.83 of 2025, registered for offences alleged under Sections 80/ 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of the Judicial Magistrate 1st Class, Chatra. 3. First Information Report being Hunterganj Police Station Case No.83 of 2025 was registered on the basis of written report filed by the informant, wherein he has alleged that the deceased and this petitioner were in love and had solemnized marriage. After marriage, the petitioner and his family members, as named in the written report used to demand dowry and torture the deceased both physically and mentally. They used to mercilessly assault the deceased. On 08.05.2025 in the morning at about 08.00 a.m. the informant received information through the villagers of Auru Village that his daughter has been killed by the accused persons. When the informant reached the in-laws’ house of the deceased, he found the deceased lying dead in the courtyard and her in-laws had escaped. It has been alleged that these persons always used to threaten the deceased that if she fails to beget the dowry, they would kill her. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that as per the First Information Report itself, the petitioner and the deceased were in love and had solemnized marriage, therefore, question of demand of dowry does not arise. He submits that the petitioner has been implicated in this case only because he is the husband of the deceased and there is no material or any specific overt act has been alleged against the petitioner. He submits that there are sufficient material in the case diary to suggest that the deceased has 2026:JHHC:8178 -: 2 :- committed suicide. As per him, the witnesses also said that she committed suicide. 5. Learned A.P.P. appearing for the State vehemently opposes the prayer for bail of the petitioner. 6. From the petition and from the arguments of the parties, I find that the deceased and the petitioner had solemnized their marriage only two months prior to the occurrence. Admittedly, it is a case of unnatural death as the cause of death is hanging. In course of investigation, the witnesses from the vicinity of the place of occurrence have also stated that there always used to be sprawl-brawl and ruckus between petitioner and the deceased. In the First Information Report and in Case Diary, the informant has stated about dowry. 7. Considering the nature of allegation and the aforesaid materials, I am not inclined to grant bail to the petitioner. Prayer for bail of the petitioner in connection with Hunterganj Police Station Case No.83 of 2025, pending in the Court of the Judicial Magistrate 1st Class, Chatra, is hereby rejected. 8. This bail application is, accordingly, dismissed. (Ananda Sen, J.) Ranchi Dated 23rd March, 2026 Kumar/Cp-03 Uploaded on 25.03.2026
