Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record. This application under Section 529 BNSS has been filed seeking direction to the court concerned to decide the Case No. 03 of 2024 (Surendra Singh vs. Nuruddin Ahmad), under Section 421 Criminal Procedure Code, Police Station Kheta Sarai, District Jaunpur, pending before the learned additional Civil Judge (J.D.), New Court Forth, Jaunpur, expeditiously within stipulated period. It is evident from the record that an application under Section 421 Cr.P.C. has been filed before the court concerned against opposite party no. 2 for the recovery of the amount in question. It further appears that the learned court concerned has issued a recovery warrant/non-bailable warrant (N.B.W.) against opposite party no. 2. Thereafter, vide order dated 20.02.2026, proceedings under Section 82 Cr.P.C. have also been initiated against opposite party no. 2 by the court concerned. In view of the aforesaid facts and circumstances, the applicant may avail the appropriate remedy before the court concerned. In the circumstances, no further order or direction is warranted by this Court. Accordingly, the application stands disposed of.
