By the way of the present petition the petitioner is seeking quashing of FIR No. 478/2018, registered at Police Station Dabri, Delhi, for the offences punishable under Sections 354B/506/34 of Indian Penal Code,1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings This is a digitally signed order. emanating therefrom on the basis of the settlement arrived at between the parties. 4. Issue notice. The learned APP for the state accepts notice on behalf of the State. 5. The petitioner and respondent no. 2 are present before this Court and have been identified by their respective learned counsels and the Investigating Officer (IO) concerned. 6. Briefly stated, the case emanates from an incident alleged to have occurred on 05.09.2018 at about 10:00 p.m., when respondent No. 2 was returning home from the market. It is alleged that petitioners Nos. 1 and 2, who were standing outside her residence along with certain other persons, threatened her and demanded that she withdraw the civil proceedings pending between the parties. Petitioner No. 2 allegedly caught hold of her arm, pulled her towards the road, tore her clothes and pushed her. It is further alleged that, when the husband of respondent No. 2 intervened, the petitioners extended threats to her life. On the basis of the aforesaid allegations, FIR No. 478/2018 was registered on 06.09.2018 at Police Station Dabri for the offences punishable under Sections 354B/506/34 of the IPC. Upon completion of investigation, the charge-sheet was filed and the proceedings are pending before the learned Trial Court. 7.
During the pendency of the proceedings, the parties amicably resolved their disputes before the Mediation Centre, Dwarka Courts, in terms of the Settlement Agreement dated 22.01.2026. They subsequently executed a Memorandum of Understanding dated 31.07.2026 and also withdrew the civil This is a digitally signed order. proceedings pending inter se. Accordingly, the present petition has been filed seeking quashing of the aforesaid FIR and all proceedings emanating therefrom. 8. On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has entered into compromise, vide Settlement Deed and MOU dated 22.01.2026 and 31.07.2026, out of her own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed. 9. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 10. Accordingly, FIR No. 478/2018, registered at Police Station Dabri, Dwarka, Delhi for the offences punishable under Sections 354B/506/34 of the IPC, 1860, along with all consequential proceedings emanating therefrom, is hereby quashed. 11. The present petition is disposed of. Pending application(s), if any, also stand(s) disposed of. 12. The order be uploaded on the website forthwith.
