JUSTICE ANIL KUMAR UPMAN Order 15/01/2026 1. These bail applications have been filed under Section 483 of BNSS on behalf of the petitioners, who have been arrested in connection with FIR No.662/2022 registered at Police Station Behror, District Bhiwadi (Rajasthan) for offences punishable under Sections 420 & 120B of IPC. Investigation is being conducted [2026:RJ-JP:1929] (2 of 3) [CRLMB-584/2026] against the petitioners for offences punishable under Sections 419, 420, 465, 467, 468, 471 & 120B of IPC. 2. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. Counsel submits that petitioners never executed any agreement in favour of the complainant. Counsel submits that in fact, complainant himself is the accused of this case. Counsel submits that according to the charge-sheet, main accused of this case are Mukesh Singh and Satveer Singh and the allegation against petitioner Pitambar Singh is that only Rs.80,000/- were given to him out of Rs.5,63,00,000/-. Counsel submits that co-accused namely- Rohit Sharma @ Chinki, Gyarsilal, Narendra Singh, Sumarjeet, Satyaveer Singh, Mukesh Rajput & Yashveer @ Chhuttan have already been granted benefit of bail by co-ordinate Bench of this Court. It is submitted that trial will take considerable time in its conclusion. Petitioners are in custody since their date of arrest and further custody of the petitioners would not serve any fruitful purpose. 3. Learned Public Prosecutor assisted by learned counsel for the complainant vehemently oppose the submissions made by counsel for the petitioner. Counsel for the complainant submits that in a planned manner, complainant has been cheated by the petitioners and co-accused persons. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, especially considering the material [2026:RJ-JP:1929] (3 of 3) [CRLMB-584/2026] available before this Court in the form of case diary, as also the fact that aforesaid co-accused persons have been granted benefit of bail by this Court as well as co-ordinate Bench of this Court; trial will take considerable time in its conclusion, but without commenting anything on the merits/demerits of the case, I deem it fit and proper to allow these bail applications. 6. These bail applications are accordingly allowed and it is directed that accused-petitioners- (1) Tikamsingh S/o Chajusingh & (2) Pitambar Singh S/o Tikam Singh shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 7. The observations made hereinabove are only for decision of these bail applications and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J LALIT MOHAN /29-30
