Order 16/01/2026
1.
Learned counsel for the petitioners has submitted that filing an appeal against the impugned order before the learned RCSAT is a compulsive mechanism, howsoever, the same is a time taking process and not an efficacious remedy.
2.
Learned counsel for the petitioners has submitted that the same is covered by the dicta encapsulated by the Co-ordinate Bench of this Court in S.B. Civil Writ Petition No.11973/2012
[2026:RJ-JP:1894] (2 of 2) [CW-595/2026] titled Dara Singh Versus State & Ors. and in S.B. Civil Writ Petition No.4599/2021 titled Shivkant Versus State of Rajasthan & Ors.
3. Considering that the matter at hand is a service matter; that the matter on the same lines had already been dealt with; that the petitioners have straight away approached to this Court bypassing the alternate remedy, and looking to the overall facts and circumstances, this Court directs the petitioners to avail the alternate remedy available, with the direction to the learned RCSAT to dispose of the instant matter, within an upper limit of 90 days of filing the appeal therein.
4. Accordingly, the present writ petition is disposed of. Pending applications, if any, shall also stand disposed.
