Heard Mr. J. C. Gogoi, learned counsel for the petitioners. Also heard Mr. M. P. Goswami, learned Additional Public Prosecutor. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioners, namely, Hariprasad Deuri and Umakanta Doley, praying for grant of bail in connection with Dispur P.S. Case No.120/2026 registered under Section 126(2)/309(6)/308(4) BNS 2024 (corresponding to GR No. 822/2026). 3. Case diary has been received. 4. The learned counsel submits order dated 13/3/2026 passed in BA 640 of 2026 granting bail to co-accused namely, Himanga Panging and draws attention to the narration in Para 6 of the order. Same may be reproduced herein below: “Seen the progress of investigation, including the statements of the accused persons has been recorded. The present petitioner in his statement has admitted that he has earlier also involved in interception of cattle carrying vehicle, but he denied that he took away any money or assaulted the driver. Considered the aspect of few days delay in lodging ejahar and the progress of investigation so far.” 5. Both the petitioners and also the other co-accused who were granted bail were arrested on 3/3/2026. 6. The learned Additional Public Prosecutor submits that investigation is not yet completed. 7. Under the given facts and circumstances and also considering the aspect of parity, I am of the considered view that the petitioners should Page No.# 3/3 also be granted bail. 8. Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.30,000/- each with one suitable surety of like amount each to the satisfaction of learned concerned court subject to the following conditions that the petitioners: (a) shall co-operate with remaining investigation. (b) Shall not hamper or tamper with evidence. (c) Shall not misuse his liberty to commit any illegal activities or offences, including any activities or offences of the kind alleged in the present case. 9. In case of violation of the bail conditions, his bail would be liable to be cancelled. 10. Accordingly, this bail application stands allowed and disposed of. 11. Return the case diary.
