This contempt petition is filed alleging willful disobedience of order dated 26.04.2014 passed in WPS No.2098 of 2014. 2. Learned counsel for petitioners would submit that as many as 10 petitioners have filed writ petition seeking relief of regularization of service. Writ petition was disposed of taking into consideration the decision of Hon’ble Supreme Court in case of Secretary, State of Karnataka and others Vs. Umadevi (3) and others, reported in (2006) 4 SCC 1 and respondent No.4/Nagar Panchayat therein was directed to take decision on the claim of petitioners within specified time and it was also observed that if further approval or sanction is required from higher authority, the same shall also be expedited . After passing of order in the writ petition, respondent No.4 has initiated proceeding of regularization of service of only 4 petitioners and therefore order passed by this Court in writ petition has not been fully complied with in its words and spirit. 3. Learned counsel for respondents submits that after passing of order, proceedings have been initiated for regularization of service of petitioners. As post of Pump Operator/Pump Attendant were not available vacant and therefore proposal was forwarded to State Govt., upon which, permission to create four supernumerary posts of Pump Operator/Pump Attendant has been granted. Accordingly, services of four petitioners have been regularized on the said post. He also submits that decision has been taken on claim of petitioners herein and it has been rejected vide order dated 08.01.2025 and therefore respondent -Nagar Panchayat has duly complied with the order passed by this Court. 3 / 3 4. I have heard learned counsel for the parties and also perused the documents annexed along with this petition. 5. Order passed by the High Court in writ petition is only to consider the claim of petitioners therein and take final decision and the Court further observed that in case, matter is required for approval or sanction of the higher authority, the same shall also be expedited. 6. From the decision taken by respondent- Nagar Panchayat it is appearing that after receipt of order, they have sent proposal for creation of supernumerary posts upon which State Govt. has granted sanction only for four post of Pump Operator/Pump Attendant and accordingly four petitioners out of ten have been regularized on the said post. 7. In the aforementioned facts of case, in the opinion of this Court, direction issued by the Court in WPS No.2098 of 2014 has been fully complied with. Therefore, I do not find any good ground to continue with this contempt petition any further. 8. Accordingly, contempt proceeding is dropped. Notice issued to respondents stand discharged. 9. Contempt Petition is closed. 10. If petitioners are not satisfied with the decision taken by respondent authority then they can take recourse to remedy available to them under the law.
