The petitioners are apprehending their arrest in connection with Barwadda P.S. Case No. 50 of 2026. It has been alleged that when the informant and his father objected to the accused persons of making construction on the land of the informant, they were brutally assaulted which resulted in Kala Chandra Mandal suffering a grievous injury. It appears that so far as the petitioner no.2 is concerned, he is said to have actively participated in committing assault upon the informant party and on account of the assault committed upon Kala Chandra Mandal with a rod, he had suffered a grievous injury. Regard being had to the specific nature of allegation levelled against the petitioner no.2, I am not inclined to grant the privilege of anticipatory bail to the petitioner no.2. The prayer for anticipatory bail to the petitioner No.2 is hereby rejected. However, as regards the petitioner no.1 and petitioner no.3 are concerned, the allegation appears to be general and omnibus in nature and considering the fact that entire episode arose out of a land dispute between the parties, the petitioner no.1 and petitioner no.3 are directed to surrender in the court below within four weeks and pray for bail, and in that event, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned JMFC at Dhanbad in connection with 2026:JHHC:15742 Barwadda P.S. Case No. 50 of 2026 subject to the conditions as laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. This application is disposed of.
