2. The present writ petition has been filed seeking a direction to the respondents to inspect the property bearing no. CA-11/2, Tagore Garden, New Delhi (hereinafter ‘subject property’) and to verify whether the construction which has taken place on the 3rd floor of the subject property is pursuant to a sanctioned plan.

W.P.(C) 10918/2026 respondent/MCD was directed to inspect the subject property and to verify whether any constructions on the third floor have been carried out and whether the construction on the third floor is in terms of a sanctioned plan.
4. Mr. Kathuria, counsel for the respondent/MCD, submits on instructions that the construction on the 3rd floor of the subject property is about 8-10 years old. He further submits that the construction on the 3rd floor of the subject property is unauthorised and therefore, MCD shall take appropriate action against the same in accordance with law.
5. In view of the above, the present writ petition is disposed of, while directing the respondent/MCD to take appropriate action in accordance with law.
6. All rights,
contentions and legal remedies of the owner/occupier/private respondent no.5 are kept open.
7. Pending application stands disposed of.
