JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.33350/2023, pending before the 1st Addl. Chief Metropolitan Magistrate Court, Bengaluru, registered for the offences under Section 498A of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri.Abhimanyu Devaiah, learned counsel appearing for the petitioner, Sri.Channappa Erappa, learned - 3 - HC-KAR NC: 2026:KHC:23068 CRL.P No. 10643 of 2024 HCGP appearing for respondent No.1, Sri.Shashi Kumar M learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo in that regard. The Joint Memo reads as follows: “The undersigned Petitioner and the Respondent humbly submit that, the matrimonial dispute between the Parties have been amicably resolved vide mediation in M.C No 7182 / 2025. the undersigned counsel for the Petitioner and Respondent No.2 submit that during meditation the total settlement amount was agreed at Rs. 12,50,000/- The Petitioner herein is paying a sum of Rs. 7,50,000/- vide DD No. 597860 drawn on State Bank of India the counsels for the Petitioner and respondent No.2 submit that the remaining sum of Rs.2,50,000/- will be paid in MC No.7182/2025 and a sum of Rs.2,50,000/- will be paid in Crl Mis 174/2023. The petitioner undertakes to clear the remaining cases i.e., MC No.7182/2025 and Crl Mis 174/2023, within 15 days from the date of this order. As such, it is humbly prayed that the Parties may pleased be allowed compound the offences under Section 498A of IPC and 3 & 4 of the DP Act, in C.C No 33350 / 2023 and consequently quash the entire proceedings pending on the file of the 8th Additional Chief Metropolitan Magistrate, Bengaluru, in the interest of justice.” 4. The respondent No.2 is present before the Court and is identified by her counsel. The petitioner is not present - 4 - HC-KAR NC: 2026:KHC:23068 CRL.P No. 10643 of 2024 before the Court today but learned counsel for the petitioner is present. 5. In the light of the Joint Memo having been filed and offences not being against the State, I deem it appropriate to accept the Joint Memo and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] FIR in Crime No.143/2023 and proceedings in C.C.No.33350/2023 pending before the 1st Addl.
