ORDER ON BOARD 12/01/2026
1. This is the second bail application filed by the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 469/2023 registered at Police Station – Takhatpur, District – Bilaspur, Chhattisgarh for the offences punishable under Sections 365, 364, 368, 302, 201, 120 (B) of the Indian Penal Code, 1860.

Learned counsel for the applicant submits that the applicant has filed this second bail application on the ground that some of the prosecution witnesses have been examined and nothing adverse has come in their statement.

Learned counsel for the Non-Applicant/State would oppose the submission of counsel for the applicant and would submit that one Kritik Yadav is the important witness and while rejecting the earlier bail application, the Court also considered the statement of Md. Zaheer recorded under Section 161 of the Cr.P.C., who was owner of the Hyundai i20 Car bearing registration no. MP 20 CL 9305 which was found to be crossing the toll plaza towards Jabalpur in CCTV footage. In support of her contention, she referred to para 5 and 6 of the order dated 15.04.2024 in M.Cr.C. No. 1404/2024.
4. After arguing for sometime, learned counsel for the applicant submits that he may be permitted to withdraw this bail application at this stage, with liberty to repeat the prayer after examination of all the material witnesses.
5. In view of the submissions made by counsel for the applicant, this bail application is dismissed as withdrawn with liberty as prayed for.
