This is an application praying for impleadment of Commissioner and Secretary to the Government of Assam, Department of Finance as party respondent No.5 in the connected WP(C) No.5531/2015. 4. The petitioner who has been engaged as Grade-IV employee in the Office of the District Sports Officer, Bongaigaon seeks for payment of arrear and current salary for the period from April, 2013 till date. 5. In the connected writ petition, the respondent Director of Sports Youth Welfare, Assam has taken a stand that the salary of the petitioner could not be released in view of the instructions from the Finance Department, Government of Assam. 6. Under the circumstances, this present application is filed for impleadment of the Commissioner and Secretary to Government of Assam, Department of Finance. 7. Having considered that the non-payment of salary to the petitioner is stated to be as per the instruction from the Finance Department, Assam, I am of the considered view that for proper determination of the connected writ petition, the Department of Finance would be necessary party. 8. Thus, the Department of Finance is required to be impleaded as party respondent No.5 in the connected writ petition. Page No.# 3/3 9. Accordingly, the Commissioner and Secretary to the Government of Assam, Department of Finance is allowed to be impleaded as respondent No.5 in WP(C) No.5531/2015. 10.
