The FIR in connection with which the petitioner was arrested and put behind the bars since, 12.08.2025, was lodged by the husband of the victim, stating inter alia that, when he was not present in the house and his wife and children were along with his mother-in-law, in the house of his mother-in-law, the petitioner along with others attacked his wife on 10.08.2025 at around 11:30 P.M. and injured her. He also submits that the petitioners as well as others have also injured his mother-in-law. The informant had stated that his wife was taken to the hospital by the villagers but then the doctors declared her dead. 4. The learned counsel for the petitioner, submits that the only eye witness in the case is the mother-in-law of the victim and in her statement before the Trial Court, she had not stated that she had seen the assault being made on her daughter. 5. Mr. K. K. Das, the learned APP for the State, however, submits that the scanned copy of the case records be called for in order to see the complicity of the petitioner. He also submits that the mother-in-law of the informant had also stated that the petitioner had attacked her too and she had received grievous injuries. 6.
Upon consideration of the submissions made by the learned counsels, more so in view of the fact that, the mother-in-law had not seen the petitioner giving the fatal blow upon her daughter and that the case will as such proceed on the circumstances as well as oral dying declaration and also due to the fact that the petitioner has been inside the jail for more than a year, this court enlarges the petitioner on bail on furnishing of a bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with one local surety of the like amount of the satisfaction of the Additional Sessions Judge (FTC), Sribhumi, under the following conditions: (i) The petitioner shall positively appear before the Trial Court as and when call for.
