This petition has been filed by the petitioner under Article 226 of the Constitution of India for issuance of direction to the respondent authorities to determine the compensation for utilizing her land situated at Village- Navagaon Patwari Halka No. 07/59 for diverted way regarding construction of bridge. 2. Learned counsel for the petitioner would submit that for constructing the bridge, petitioner’s land is being used without giving any compensation which will destroy the character of her land and the same will not be in position to use in future. 3. In pursuance of direction issued by this Court, Mr. Bhushan Dev ARUN KUMAR DEWANGAN Digitally signed by ARUN KUMAR DEWANGAN Date: 2026.01.13 17:00:04 +0530 2 Shende, Sub-Divisional Officer, PWD, Bridge Sub-Division, Kawardha is present before this Court through video conferencing and would submit that other villagers have already granted consent for utilizing their land for diverting way till construction of the bridge. He would further submit that after construction of the bridge, the land will be again in possession of the land owner and if the character of the land is changed, they will restore the same utilizing machine and if Murum is used in the land that will also be removed from the land. He would further submit that the tender proceeding is in progress and thereafter work order will be issue and they will conclude the proceeding within the stipulated time period. He would further submit that they will restore the shape and character as exists before utilizing the land by them. 4. Since sufficient safeguard has been made by the department for construction of road, therefore, nothing is required to be adjudicated by this Court in this petition at this stage. However, the respondents are directed to conclude their proceeding for construction of bridge and immediately after construction of the same, the petitioner’s land will be handed over after restoring its character. 5.
