3
1. B PARAMESEWARA RAO Counsel for the Respondent(S):
1.
GP FOR HOME
2. GP FOR REVENUE
3. GP FOR CIVIL SUPPLIES The Court made the following:
4
ORDER:
To declare the action of the respondent Nos.2 to 7 in not initiating action against respondent Nos.8 to 10, basing on the legal notices dated 12.07.2021, 29.07.2021 and 30.07.2021 issued by the petitioner, as illegal and arbitrary, the present writ petition is filed.
2. Heard Sri B.Parameswara Rao, learned counsel for the petitioner and Sri Vineeth Appasani, learned Assistant Government Pleader for Civil Supplies for the respondents.
3.
Learned counsel for the petitioner submitted that the ration cards of the unofficial respondents are bogus ration cards and in that regard, three legal notices have been issued to take action against the said bogus cards. Despite the same, no action has been initiated. Accordingly, he prayed to dispose of the writ petition directing the authorities to act upon the legal notices submitted by the petitioner.
4. On the other hand, Sri Vineeth Appasani, learned Assistant Government Pleader for Civil Supplies, submitted that the petitioner has no locus to file such writ petition, there is no infringement of petitioner’s legal right. Further, the petitioner is a resident of Bangalore and, in said view of the fact, the writ petition has to be dismissed.
5. In reply, learned counsel for the petitioner submitted that the unofficial respondents attacked the petitioner’s father and in those
5
circumstances, after noticing that they are bogus cardholders, such complaint has been given.
6. Perused the record and considered the submissions made by
learned counsel for the parties.
7. As could be culled out from the facts and circumstances of the case, it can be presumed that only to take vengeance against the unofficial respondents, the present writ petition came to be filed. That too, the writ petitioner is a resident of Banglore. Further, there is no material or basis to say that the unofficial respondents are having bogus ration cards. As rightly contended by the learned Assistant Government Pleader, the petitioner has no locus to file the present writ petition under Article 227 of the Constitution of India.
8. Accordingly, the Writ Petition is dismissed with exemplary costs of Rs.5,000/-, which shall be paid by the petitioner to the Andhra Pradesh High Court Legal Services Committee, within a period of two (02) weeks, from the date of receipt of copy of this order and file a compliance report before the Registrar (Judicial). There shall be no order as to costs.
As a sequel, miscellaneous applications, pending if any, shall stand closed. _____________________________
