[2026:RJ-JP:1231] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Miscellaneous Application No.9/2026 Lalchand ----Petitioner Versus Smt. Naina Devi ----Respondent For Petitioner(s) : By Court Order For Respondent(s) : HON'BLE MR. JUSTICE ANAND SHARMA Order 13/01/2026 1. Pursuant to Office note dated 06.01.2026 prepared by Registrar (Judicial), the instant S.B. Civil Miscellaneous Application No.9/2026 has been listed along with 1216 Civil Stay Applications, details of which have been given in the schedule appended to the Office note dated 06.01.2026. Bare perusal of the note as well as the details of the schedule would make it clear that the main cases in all these matters have already been disposed of. 2. It is a settled proposition that any stay application or miscellaneous application filed in the main case, automatically stands disposed along with disposal of the main case and there is no provision in the Rules of the High Court of Judicature for Rajasthan, 1952 for listing any civil miscellaneous stay application independently without there being any pending main case. 3. Thus, it is totally misconceivable, where the civil miscellaneous stay applications have been listed, treating the same to be pending, despite disposal of the main cases. [2026:RJ-JP:1231] (2 of 2) [CMAP-9/2026] 4. Be that as it may, since main cases have already been disposed of, therefore, the instant S.B. Civil Miscellaneous Application No.9/2026 along with 1216 Civil Miscellaneous Stay Applications appended to Office note dated 06.01.2026 prepared by Registrar (Judicial) are hereby consigned to record. Aforesaid Office note along with schedule of 1216 Civil Miscellaneous Stay Applications shall form part and parcel of this order. 5. Accordingly, the present application along with other Civil Miscellaneous Stay Applications stand disposed of. 6. Office is directed to keep one copy of this order in each respective file shown in the schedule appended to the Office note dated 06.01.2026. (ANAND SHARMA),J DAKSH/1
