JUSTICE M.I.ARUN ORAL ORDER 1. Admittedly, the petitioners have not obtained any sanction plan to put up construction on the property claimed by them. 2. The writ petition has been filed challenging the order issued by the respondent-authorities to demolish the illegal structure put up by the petitioners. The case of the respondents is that the petitioners have not obtained the necessary sanction plan and that the construction is also put up on a storm water drainage. This Court on 28.01.2026 has passed the following order:- "1. Learned AGA accepts notice for respondents No.1 and 2. 2. Sri.Padmanabha, learned counsel is directed to accept notice for Respondent No.3. 3. The jurisdictional ADLR along with respondent No.3 are directed to carry out survey of the property of the petitioners, the land in Sy.Nos.24/1 and 24/3 and the land in Sy.No.9/3 of Gangondanahalli Village, Dasanpura Hobli, Bengaluru North Taluk to ascertain the location of the halla/’B’ Kharab in both the aforesaid survey numbers to demarcate the same, then to ascertain if the construction put up by the petitioners is situated in any of the aforesaid halla/’B’ Kharab. - 4 - HC-KAR NC: 2026:KHC:13525 WP No. 2031 of 2026 4. The said survey to be carried out commencing from 10.30 a.m. on 03.02.2026. Report to be submitted by 10.02.2026. 5. Re-list on 16.2.2026. 6. Until then, the respondents are restrained from demolishing the construction put up by the petitioners. The petitioners are also restrained from putting up any further construction or carrying out any construction activity in the said premises. 7. Acknowledgement of serving a copy on the respective counsel for the respondents to be filed with the registry by the end of the day of 29.01.2026, failing which, the interim order would stand automatically vacated." 3. Subsequently, the jurisdictional ADLR has submitted a report stating that the petitioners have indeed put up construction on an existing storm water drainage, which cannot be permissible in law. 4.
