W.P.CRl..(MD).No.1559 of 2026 Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 to 3 to provide proper and adequate medical treatment to the petitioner's husband namely Oorkavalan, who is presently confined in Central Prison Madurai, by considering the petitioner's representation dated 11.03.2026 within the time limit stipulated by this Court and consequently refer him to Government Rajaji Hospital or any other specilized Government Hospital for proper treatment of the gunshot injury sustained on his right leg. 2. When the Writ Petition came up for hearing on 18.03.2026, it was informed to the Court that the detenue had already been shifted to the Central Prison, Vellore and was undergoing treatment. Hence, this Court suo-motu impleaded the fifth respondent and directed the learned Additional Public Prosecutor to take instructions from the 5th respondent and listed the matter for hearing today. 3. When the matter was taken up for hearing today, the report of the Assistant Professor, Orthopaedics Department, Government Vellore Medical College Hospital, Vellore, was placed before this Court and the said report is extracted hereunder: Patient Alleged History of Gun Shot Inqury over Right Knee on 07.03.2026 at 12.30 PM. Patient as treated immediately at Thriupuam Govt. Hospital in Half an hour with suturing of gun shot injury wound over right knee. Patient was then taken to Govt.
Rajaji hospital Madurai, treated with wound wash, Debridement, Suturing of the Gun Shot Injury over Right knes, X-ray was taken CT-Scan Right knee Taken. Tube Caste applied Patient was Discharge from Madurai Govt. Rajaji Hospital on 17.03.2020 at 3.00 PM Patient was Shifted Madurai Prison and was give ____________ https://www.mhc.tn.gov.in/judis
W.P.CRl..(MD).No.1559 of 2026 medications for 13 days. Now patient has been brought by police from Vellore prison on 30.03.2026 at 12.15. Pm for evaluation and treatment regarding Injury. Patient brought with Tube Cast Right Leg. Tube Cast removed Right lower Limb fully Inspected Gun Shot Wound healed and healthy. Tube Cast reapplied. Dorsalis paedis plus Present Right side no clinical evidence of any Neurological Deficit over Right lower limb X-ray Right khee Anteroposterior and Lateral view show Fracture Right patella. CT Scan Right knee show Minimally Displaced Communited Fracture patella Right Side. Patient planned for Conservative Treatment with plaster of Paris Tube Cast Right Side Patient can be Treated as Out Patient. Advised to review in Orthopedics Out Patient Department after One Week for serial Monitoring. 4.
