$~94 * IN THE HIGH COURT OF DELHI AT NEW DELHI # CNR No. DLHC010196452026 + W.P.(C) 6119/2026 NIRAJ KUMAR SINGH .....Petitioner Through: Mr. Yash Trivedi, Adv. versus GOVT OF NCT OF DELHI AND ANR. .....Respondents Through: Ms. Aanchal Rajput, on behalf of Ms. Vaishali Gupta, Panel Counsel (Civil) GNCTD for R-1 Mr. Sahil Ralli, Ms. Reet Srivastava, Advs. for R-2
CORAM:
HON'BLE MR. JUSTICE JASMEET SINGH O R D E R % 12.08.2026
1. This is a writ petition filed under Articles 226 and 227 of the Constitution of India seeking the following prayers :-
“a) De-freezing the bank account of the petitioner bearing no.50100255189716, HDFC bank, branch- hemkunt chambers, Nehru place g2&3, New Delhi 110019. b) Issue a writ of Mandamus or any other appropriate writ,
order, or direction directing Respondent No. 2 to de-freeze the petitioner’s bank account forthwith;…”
2. The brief facts of the case are that the petitioner is a shopkeeper of glass and aluminium at Adarsh Nagar, New Delhi and maintains a savings/current bank account bearing No. 50100255189716 in HDFC Bank, the respondent No. 2, in Branch Hemkunt Chambers, Nehru Place G2&3, New Delhi-110019. 3. On a complaint dated 24.12.2025 against the petitioner in Police This is a digitally signed order. Station Gornatla District Sri Sathya Sai Andhra Pradesh, the bank account of the petitioner was freezed. 4. Ms. Srivastava, learned counsel, appears on behalf of respondent HDFC bank and states that the disputed amount is Rs. 649. 5. Mr. Trivedi, learned counsel for the petitioner, argues that the petitioner is totally unaware of the disputed transaction, and he states is not related to the business work of the petitioner. 6. I am of the view that the freezing of an account is an action entailing serious consequences creating extreme hardships and inconvenience for the petitioner herein as the same happens to be the business account of the petitioner. The respondent No. 2 cannot be permitted to take such harsh measures without any application of mind. 7. For the said reasons, the impugned action of account freezing in the present case is disproportionate and an arbitrary exercise of power thereby striking a blow at the fundamental rights of the petitioner. The impugned action is without due application of mind as an indiscriminate blanket freeze has been imposed on the account of the petitioner for an allegedly suspicious entry of a meagre amount of Rs. 649/-. 8. Consequently, the petition is allowed, and it is hereby directed that the savings/current account of the petitioner bearing No. 50100255189716 maintained with the respondent No. 2 in Branch Hemkunt Chambers, Nehru Place G2&3, New Delhi-110019, shall be defreezed, subject to a lien on the amount of Rs.649. 9. Mr. Trivedi, learned counsel for the petitioner, states that he will initiate action under the Standard Operating Procedure (“SOP”) for This is a digitally signed order.
