JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.2 under Section 483 of BNSS praying to grant bail in Crime No.262/2025 of Koratagere Police Station registered for offences punishable under Sections 15(2), 109, 351(2), 352 read with Section 3(5) of BNS. 2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent –State. 3. Learned counsel for the petitioner would contend that overtact alleged against this petitioner is assaulting with the hands to the first informant. Overtacts alleged against accused No.1 is assaulted with knife on right side of ribs. The injured has been sustained two simple injuries. The petitioner is in judicial custody since 14.12.2020. Per contra, learned High Court Government Pleader for the respondent –State would contend that the injured has sustained two simple injuries. The petitioner is having criminal antecedents involved in Crime No.244/2025 of Koratagere Police Station. The investigation is in progress. With this, he prays to reject the petition. 5. Having heard learned counsels, the Court has perused the FIR, complaint and other materials is placed on record. 6. On perusal of the complaint, it indicates that there was quarrel between the first informant and accused persons in the wine store. At that time, this petitioner – accused No.2 has assaulted the first informant with hands and abused him by filthy words. There is no serious overtact alleged against this petitioner assaulting the injured with deadly weapon. The said allegation of assaulting the injured with knife is against accused No.1. This petitioner is stated to have stopped accused No.1 - 4 - HC-KAR NC: 2026:KHC:10652 CRL.P No. 281 of 2026 from assaulting the injured. The wound certificate indicates that the injured has sustained two simple injuries. The petitioner is in judicial custody since 14.12.2025 and as major portion of investigation is over, he is not required for further custodial interrogation. Considering the above aspect, the petitioner has made out case for grant of bail with conditions. 7. In the result, the following ORDER i) The petition is allowed. ii) The petitioner is granted bail in Crime No. Crime No.262/2025 of Koratagere Police Station subject to following conditions: a) The petitioner –accused No.2 shall execute bail bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court. - 5 - HC-KAR NC: 2026:KHC:10652 CRL.P No. 281 of 2026 b) The petitioner –accused No.2 shall not tamper the prosecution witnesses either directly or indirectly. c) The petitioner –accused No.2 shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
