The case of the prosecution in brief is that due to family disputes, the petitioners along with other accused beat the de facto complainant, assaulted his wife and his son with hands, legs and sticks and thereby caused bleeding injuries to them. Based on the complaint given by the de facto complainant, the present crime was registered. 4. Learned counsel for the petitioners would submit that no specific overt acts are attributed to the petitioners. The present case has been falsely foisted only due to family disputes. Learned counsel would further submit that the de facto complainant having personal grudge and rivalry with the accused, has 4 lodged the complaint implicating the petitioners herein, and therefore, prays that pre-arrest bail be granted to the petitioners. 5. Mr. K. Sandeep, learned Assistant Public Prosecutor, would submit that investigation is at nascent stage and the involvement of petitioners herein in the alleged offence is clearly made out. Hence, prays to dismiss the bail application. 6. Considering the submissions made and on perusal of the material available on record, the presence of the petitioners at the scene of offence cannot be ruled out in the light of the specific overt acts to the petitioners herein and the investigation is at a nascent stage. Hence, this is not a fit case to grant pre-arrest bail to the petitioners at this stage. 7. In the result, the Criminal Petition is dismissed. However, the petitioners are at liberty to surrender before the Magistrate Court concerned within one (1) week and file an application for regular bail. The learned Jurisdictional Court concerned is directed to dispose of the said application in accordance with law, on its own merits by giving due and sufficient opportunity to the learned Public Prosecutor concerned, and pass appropriate orders as expeditiously as possible. ___________________________________ DR.VENKATA JYOTHIRMAI PRATAPA, J Date: 03.02.2026 KA 5 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 416/2026 Date: 03.02.2026 KA
