District Judge, Mandya District, Mandya in Execution Petition No.118/2022, which is produced at Annexure-N and quash the same; ii. To grant any other relief/reliefs as this Hon'ble court deems fit to grant, in the circumstances of the case and award costs, in the interest of justice and equity.” 2. Learned counsel for both sides jointly submit that the proceedings before the Executing court are posted on 04.04.2026 and the same may be preponed / advanced to 05.03.2026 with a direction to the Executing court to consider the claim of respondent – Decree Holder and the objections of the petitioners and record a finding as to the actual amount payable by the petitioners and thereafter proceed further in accordance with law. The said submission is placed on record. 3. In view of the aforesaid joint submissions made by both sides, I deem it just and appropriate to dispose of this petition by issuing certain directions in this regard. - 3 - HC-KAR NC: 2026:KHC:9696 WP No. 25993 of 2025 4. In the result, I pass the following:- ORDER (i) Petition is hereby disposed of. (ii) The Executing court is directed to prepone / advance the case from 04.04.2026 to 05.03.2026. (iii) Liberty is reserved in favour of both sides to file advancement application and also to file their respective memos of calculations. (iv) Immediately upon the matter being advanced, the Executing court shall consider the rival contentions of both the parties and pass appropriate orders on the exact amount payable by the petitioners to the respondent within a period of one month from 05.03.2026. (v) Liberty is reserved in favour of both parties to file their pleadings, documents etc., before the Executing Court.
