None appears on behalf of the applicant to press this application when the case is called out, however, with the assistance of the learned State counsel, this Court proceeds to hear and decide this bail application. 2. This is the Second bail application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 107/2025 registered at Police Station – Basantpur, District Balrampur-Ramanujganj (C.G.), for the offence punishable under Sections 15(c), 25 and 29 of the Narcotic PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.01.09 17:54:52 +0530
2 Drugs and Psychotropic Substances Act, 1985. 3. The prosecution story, in brief, is that on the intervening night of 07.06.2025 and 08.06.2025, while police personnel of Police Station Basantpur were on night patrol, they received secret information that a truck bearing registration No. RJ-19-GJ-7447 was parked near the Dhanwar barrier. Upon receiving the said information, the police party reached the spot and found the truck abandoned at the said place. During a search of the vehicle, 14 quintals and 44 kilograms of doda (poppy straw) were recovered from the truck. Thereafter, after completing all formalities in accordance with the provisions of the Narcotic Drugs and Psychotropic Substances Act, 1985, the police registered the alleged offences punishable under Sections 15(c), 25, and 29 of the said Act against the driver and the owner of the said vehicle. 4. The first bail application of the applicant was rejected by this Court on merits vide order dated 22.09.2025 passed in MCRC No. 7230/2025. The only ground now argued, as stated in the present bail application, is that the applicant is a kidney patient and has been in jail for the last seven months. Further, out of 13 prosecution witnesses, none has been examined till date. 5.
Learned counsel for the State opposes the bail application and submit that the charge-sheet has been filed in the present case before the competent Court. He further submits that first bail application of the applicant was rejected by this Court on merit vide order dated 22.09.2025 passed in MCRC No. 7230/2025, as such, the applicant is not entitled to be released on bail. 6. I have heard learned counsel appearing for the applicant and perused the case diary. 3

After hearing the submissions advanced by the learned counsel for the parties, and considering the fact that this is the applicant's second bail application, the first bail application of the applicant was rejected by this Court on merits vide order dated 22.09.2025 passed in MCRC No. 7230/2025 on the ground that the contraband article i.e. Ganja, which has been seized from the possession of the applicant, is much above the commercial quantity and the only ground now argued, as stated in the present bail application, is that the applicant is a kidney patient and has been in jail for the last seven months, further out of 13 prosecution witnesses, none has been examined till date; however, no order sheet has been annexed to demonstrate the present status of the trial, this Court is of the view that it is not a fit case to enlarge the applicant on bail. 8. Accordingly, the second bail application of the applicant - Raju Singh filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, involved in Crime No. 107/2025 registered at Police Station – Basantpur, District Balrampur-Ramanujganj (C.G.), for the offence punishable under Sections 15(c), 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
