The allegations in the FIR dated 05.09.2026 reveal that the accused applicant, along with some other unknown persons, have been operating around the Gossaigaon Police Station an organized group or gang, whereby they targeted vulnerable members of the public and falsely represent themselves as advocates, legal practitioners, or persons authorized or attached to the Police Department, and thereby deceived the people, claiming that they can procure registration, withdrawal, alteration, compromise, or transfer of criminal cases in exchange of money. 4. It is also alleged against the group that they have been indulged in preparing and filing false FIRs and thereafter, by threatening the victims with implications in serious offences, including offences under POCSO and NDPS, extort money from them for compromising or settling those cases from the so called victims. 5. On receipt of the FIR, police registered Gossaigaon Police Station Case No. 206/2026 under the aforementioned sections. 6. Mr. A.W. Ahmed, the learned counsel appearing for the accused applicant submits that there has not been any specific allegation against the accused applicant and all the allegations in the FIR are vague and not substantive. He submits that a co-accused in the instant case has already been granted bail by a Coordinate Bench of this Court. Page No.# 3/3
7. In view of the aforesaid submissions, he submits that since the accused applicant is already behind the bars for 23 days, they should be enlarged on bail. 8.
The learned Additional Public Prosecutor, on the other hand, opposes the prayer of bail of the accused applicant. 9. The Case Diary in the instant case has been received and the same is perused. 10. On perusal of the CD, it is found that the accused applicant has been specifically named and implicated by several witnesses in the instant case. 11. This Court has considered the submissions made by the counsel appearing for the respective parties. 12. It is also a fact that the gang, including the accused applicant has been operating for quite some time and involving many other persons, effecting the public at large. 13. Taking into account the kind of allegations made in the FIR as well as materials available in the case diary, this Court is not inclined to grant any relief to the accused applicant at this stage. 14. Accordingly, the instant bail application is rejected. JUDGE
