JUSTICE BUDI HABUNG ORDER Date : 30-09-2026 Heard Mr. T. Tapak, learned counsel for the petitioner and Mr. T. Tagum, learned Standing Counsel, Education Department, appearing for the respondents. 2. Having regard to the nature of grievance projected by the petitioner, the writ petition is taken up for disposal at this stage. 3. The case of the petitioner is that she is a Teacher serving under the Department of Education, Government of Arunachal Pradesh and is presently posted at Government Secondary School, Balek, East Siang District. That, on the ground of rationalization of teachers, she has been transferred and posted to Government Higher Secondary School, Pongchau, Longding District, vide common Transfer and Posting Order dated 30.06.2026, wherein her name appears at Serial No.110. According to the petitioner, the said transfer has been effected during the middle of the academic session and before completion of her prescribed tenure at the present place of posting. 4. Mr. Tapak, learned counsel for the petitioner submits that the impugned transfer order has been issued contrary to the Transfer and Posting Policy of Teachers, 2025, which contemplates issuance of transfer orders before commencement of the academic session so as to protect the academic interest of the students. It is further submitted that the petitioner has also been engaged as an Enumerator by the General Administration Department and the impugned transfer would cause considerable hardship to her. Learned counsel for the petitioner further submits that being aggrieved by the impugned transfer order, the petitioner submitted a representation dated 06.07.2026 before the Commissioner (Education), Government of Arunachal Pradesh, seeking her retention at the present place of posting. However, the said representation has not been considered till date. In the meantime, the Deputy Director of School Education, Pasighat, has issued an order dated 15.09.2026 directing release of all transferred teachers within a period of 7 (seven) days. 6. Learned counsel for the petitioner has also drawn the attention of this Court to the order passed in W.P.(C) No.476/2026 and submits that in similar circumstances this Court had directed consideration of the pending representation and had protected the petitioner therein from being released till disposal of the representation. 7. Considering the above submission and upon perusal of the materials available on record, this Court is of the considered view that since the representation of the petitioner has not been considered and disposed of by the competent authority, the petitioner should file a fresh representation before the Secretary to the Government of Arunachal Pradesh, Education Department, within a period of 07 (seven) days from today. The said authority, upon receipt of the representation, shall consider the same and dispose of it by passing a reasoned and speaking order as expeditiously as possible and, in any event, within a period of 1 (one) month from the date of receipt of the representation. 8. It is further provided that till such time an order is passed by the Secretary to the Government of Arunachal Pradesh, Education Department, the respondent shall not release the petitioner in pursuance to the common Transfer and Posting Order dated 30.06.2026.
