2/29.05.2026 Heard Mr. Sudhansu Kr. Deo, learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is apprehending his arrest in connection with Deoghar Town P.S. Case No. 24 of 2026.
It has been alleged that several accused persons assembled and entered into the house of Manoj Kumar Ram with pistols and demanded extortion money from the said Manoj Kumar Ram.
It has further been alleged that on information, the police had come and apprehended 12 accused persons and on search of their possession, arms and ammunition have been recovered.
Submission has been advanced by the learned counsel for the petitioner that in respect to the same incident, the victim Manoj Kumar Ram had lodged the first information report being Deoghar Town P.S. Case No. 23 of 2026, in which the petitioner is not named.
It has been submitted that subsequently, the police have lodged an FIR citing Manoj Kumar Ram as a victim and included the name of the petitioner for the occurrence which had taken place on the same day.
Learned counsel submits that the allegations against the petitioner are general and omnibus in nature.
Learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioner.
Regard being had to the fact that in the initial FIR, the said Manoj Kumar Ram had not named the petitioner as a member of the unlawful
-2- assembly, I am inclined to extend the privilege of anticipatory bail to the petitioner.
Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Deoghar in connection with Deoghar Town P.S.
