NARENDRA PRASAD ORAL ORDER This writ petition is filed by the plaintiff under Article 227 of the Constitution of India, seeking the following relief: - 3 - HC-KAR NC: 2026:KHC:22915 WP No. 12956 of 2026 “Issue a writ of mandamus or any other appropriate writ directing the II Additional Senior Civil Judge, Bengaluru Rural District, Bengaluru in O.S.No.1198/2021 to conclude the cross examination within a stipulated time limit of four weeks.” 2. For the sake of convenience, the parties are referred to according to their ranking before the trial court. 3. The petitioner/plaintiff filed a suit in O.S. No. 1198/2021 seeking declaration and permanent injunction. Upon service of summons, the defendants appeared through counsel and filed their written statement. Based on the pleadings of the parties, the trial court framed the issues. The matter was set down for the plaintiff’s evidence; the plaintiff has been examined as PW1, and the case is now posted for the evidence of PW2, namely, G.R. Venkata Reddy. 4. The learned counsel appearing for the petitioner/ plaintiff submits that PW2 is about 75 years old and is - 4 - HC-KAR NC: 2026:KHC:22915 WP No. 12956 of 2026 suffering from age-related ailments. Therefore, it is requested that the cross-examination of PW2 be completed within an outer limit of four weeks. 5. In view of the above, without expressing any opinion on the merits of the case, this writ petition stands disposed of with a direction to the trial court to conclude the evidence of PW2 by the end of June 2026.
