The petitioner, above-named, who is in custody since 21.05.2025 in connection with Musabani (East Singhbhum) P.S. Case No. 29 of 2025 for the offence registered under Sections 140(1) of the BNS, 2023 and thereafter vide order dated 21.05.2025, Section 103(1), 238 and 3(5) of BNS, 2023 and Sections 3 and 4 of the Witchcraft Prohibition Act was subsequently added has prayed for regular bail. As per the prosecution case, the matter involves abduction and killing the mother of the informant and another women on suspicion that she was practicing witchcraft, which resulted in the death of the daughter of Soma Bodra by snake bite. It is submitted by the learned counsel on behalf of petitioner that the case has been lodged four days after the alleged incidence. Petitioner is not named in the FIR and the only material is confession of the co- accused persons. The confessional statement of Soma Bodra was recorded on 20.05.2025 at 7:15 am and thereafter the confessional statement of the petitioner and others were recorded at 7:45 and onwards. Therefore, their statement cannot be regarded to be the disclosure made on the basis of which, the dead body was recovered. Learned A.P.P. for the State has opposed the prayer for bail. It is submitted that the incidence took place in two parts, first is that the accused persons entered into the house of the informant and the second is that the deceased was abducted and then her dead-bodies was recovered on the basis of disclosure statement. 2026:JHHC:3561 2 Matter involves double murder. On the disclosure statement made by this petitioner and others, the dead bodies were exhumed.
