2. The present petition has been filed by the petitioners with the following prayer:
"It is, therefore, prayed that the Hon’ble High Court may kindly be pleased to allow this petition and quash the F.I.R. No. 21/2023 dated 20.03.2023 registered against the petitioner for the offence u/s 498A and 34 of I.P.C. by the Police Station Mahila Thana, District Bilaspur (C.G.), in the interest of justice."
3. It transpires from the record that by the prayer made in the present petition the petitioners have challenged the FIR. On being pointed query made from the
learned counsel for the petitioners that when the charge sheet has been filed way back in the year 2023 on 20-04-2023 and copy of the same has been annexed with the petition as Annexure-P/1, then why only the FIR has been challenged, she could not give any reply.
4. At this stage, learned counsel for the petitioners seeks permission to withdraw the present petition with liberty to file a duly constituted petition afresh challenging the charge sheet.
5. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty subject to depositing a sum of Rs.5,000/- as cost by each of the petitioners in the Registry of this Court within a period of one week from today and the said amount, i.e., Rs.10,000/- shall be transmitted to the Govt. Special School for Visual and Hearing Impaired, Tifra, District Bilaspur.
6. Copy of the charge sheet annexed with the petition be returned back to the
