This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 387/2020 registered at Police Station Simga, District – Balodabazar-Bhatapara (C.G.), for the offence punishable under Sections 4, 6, 7, 9, 10, 11 of Chhattisgarh Agriculture Cattle Preservation Act, 2004 and Sections 48 and 52 of Chhattisgarh Animal Transportation Act, 1978 and Sections 49, 49(A) and Section 50 of the Prevention of Cruelty to Animal Act, 1960. As per the prosecution story, in brief, on 07.11.2020, one Sameer Khan was transporting 20 cattle in a truck bearing registration No. CG-08-AH- 0785 and was allegedly transporting the cattle illegally. On this basis, an offence was registered. During the course of investigation, it was found that the owner of the above-mentioned truck bearing No. CG-08-AH- 0785 is the present applicant. Thereafter, the concerned police station registered Crime No. 387/2020 at Police Station Simga against Sameer Khan for the aforesaid offence. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He submits that the applicant is a permanent resident of the said village as mentioned in the cause title and was never absconding. He also submits that the applicant had executed a rent agreement dated 01.08.2020 in respect of the truck with Sameer Khan, who is the main accused in the present case, and as per the said rent agreement, Sameer Khan used to pay a sum of Rs. 50,000/- per month to the present applicant in lieu of the said vehicle. He further submits that the name of the present applicant has not been mentioned in the F.I.R., and solely on the basis of the memorandum statement of the accused person, the present applicant has been falsely implicated in the present case. He submits that the said cattle were not seized from the possession of the present applicant. Since, the name of the applicant was not mentioned in the F.I.R., upon coming to the knowledge of the said F.I.R., the applicant preferred an application for anticipatory bail before this Hon’ble Court, which was registered as M.Cr.C.(A) No. 1067/2025 and was disposed of vide order dated 21/07/2025. He submits that the other co-accused persons have already been granted bail by this Hon’ble Court vide order dated 29.01.2021 passed in M.Cr.C. No. 9250/2020. He further submits that the applicant has no criminal 3 antecedents and he is in jail since 02.12.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 4. Learned counsel appearing for the State/non-applicant would oppose the bail application of the applicant and submits that on 07.11.2020, one Sameer Khan was allegedly transporting 20 cattle illegally in a truck bearing registration No. CG-08-AH-0785. On this basis, an offence was registered. She further submits that, during the course of investigation, it was found that the owner of the said truck is the present applicant. She also submits that the applicant had been absconding since the time of the incident and was eventually arrested on 02.12.2025, therefore, he is not entitled for grant of regular bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and the fact that 07.11.2020, one Sameer Khan was allegedly transporting 20 cattle illegally in a truck bearing registration No. CG-08-AH-0785. On this basis, an offence was registered and during the course of investigation, it was found that the owner of the said truck is the present applicant, moreover, the fact that as the matter pertains to the year 2020 and the applicant has been absconding since the incident took place and arrested on 02.12.2025, there is every likelihood, that if he is granted bail, he will abscond again, and further, hamper the trial, therefore, I am not inclined to grant regular bail to the present applicant. 7. Accordingly, the bail application of the applicant - Dhanuklal Dhankar, involved in Crime No. 387/2020 registered at Police Station Simga, District – Balodabazar-Bhatapara (C.G.), for the offence punishable 4 under Sections 4, 6, 7, 9, 10, 11 of Chhattisgarh Agriculture Cattle Preservation Act, 2004 and Sections 48 and 52 of Chhattisgarh Animal Transportation Act, 1978 and Sections 49, 49(A) and Section 50 of the Prevention of Cruelty to Animal Act, 1960, is rejected. 8.
