HC-KAR NC: 2026:KHC:13444 WP No. 38825 of 2025 ORAL ORDER The captioned petition is filed seeking mandamus from this Court to issue direction to respondent No.2 to consider the petitioner's representation/complaint dated 24.05.2025 and further direct respondent No.2 to take necessary action on the complaint lodged by the petitioner. 2. Heard learned counsel appearing for the petitioner and learned AGA for the respondents. Perused the records. 3. Perusal of the records, it appears that the dispute relates to an agricultural land bearing Sy.No.39/3 measuring 1 acre 14 guntas. The petitioner asserts that though the petitioner's father has in fact purchased Sy.No.40/3, it is wrongly reflected as Sy.No.39/3. 4. On examining the order passed by the co-ordinate bench in W.P.No.11052/2022, in a previous suit instituted by the petitioner in O.S.No.121/2009, though dismissed and confirmed by the Appellate Court in R.A.No.4/2015, the writ court adverted to the finding recorded on possession. The writ court also adverted to the observation made by this Court in RSA.No.1389/2015 while dismissing the petitioner's second

HC-KAR NC: 2026:KHC:13444 WP No. 38825 of 2025 appeal, reserving liberty to the petitioner to file a comprehensive suit. 5. In view of ambiguity in regard to the survey number, there appears to be a dispute between a petitioner and private parties, who are not party to this writ petition. Be that as it may. If a petitioner has filed a comprehensive suit arraying the private parties and defendants, the petitioner has to seek appropriate interim reliefs in the pending suit now filed pursuant to disposal of the writ petition. The second respondent's reluctance to entertain a complaint on the ground that the dispute is purely civil in nature cannot be faulted. If such an endorsement is issued, this Court is of the view that the petitioner's remedy lies before the competent Civil Court. While his title is negated by two courts, this Court, while dismissing RSA.No.1389/2015, has reserved liberty to the petitioner to file a fresh comprehensive suit and seek all possible reliefs against the private parties. The fact that a comprehensive suit is filed, the petitioner has to seek reversal of his grievances in the pending suit.
Therefore, this is not a fit case where a direction can be issued to the second respondent

HC-KAR NC: 2026:KHC:13444 WP No. 38825 of 2025 to contemplate action based on the complaint lodged by the petitioner vide Annexure-J. The endorsement vide Annexure-H does not suffer from any illegality. Since the parties are found to be litigating before a competent Civil Court as well as have been litigating in revenue proceedings, the petitioner has to get his rights adjudicated in the pending suit. With these observations, the writ petition stands
