2. The petitioner is the owner and resident of flat bearing no. B-41, Ground Floor, Cosy Apartments, Sector-09, Rohini, Delhi-110085 (‘subject property’). Respondents no.3 to 6 are residents of second and third floor in the same building.
3. The grievance of the petitioner is that the respondents no.3 to 6 are carrying out construction of lift in the building in violation of the Lift Policy as reflected in Office Order dated 7th July, 2022 issued by MCD, the Building Bye-Laws as well as the No Objection Certificate (‘NOC’) granted to them by MCD on 12th June, 2026.
4. Mr. Vijay K. Gupta, counsel appears on behalf of the private respondents no.3 to 6 and submits that installation of the lift is being carried out strictly in terms of the NOC granted by the MCD as well as the applicable Office Order issued by MCD on 7th July, 2022.
5. Having heard the counsel for the parties, the present writ petition is
disposed of while directing the respondent/MCD to ensure that the installation of lift is carried out strictly in terms of the NOC granted by MCD as well as Office Order dated 7th July, 2022 and in terms of the Unified Building Bye-Laws.
6. The pending application stands disposed of.
