1. After some hearing, Mr. Sabharwal, learned counsel for the petitioner only restricts his prayer to a request to the Tribunal to take up and decide MA 3694/2026 filed by him. He is also agreeable to comply with the impugned order dated 29 May 2026 passed by the Tribunal subject, however, to the outcome of the MA.
2. Accordingly, subject to the petitioner complying with the impugned order passed by the Tribunal and showing proof thereof to the Tribunal, we request the Tribunal to take up the MA 3694/2026 Digitally Signed By:AJIT KUMAR Signing Date:13.08.2026 18:31:57 Signature Not Verified
WP(C) 11552/2026 filed by the petitioner for modification / vacation of the impugned stay
order on 27 August 2026. We, however, make two aspects clear. The first is that, we have not pronounced in any manner on the merit of the dispute or on the merit of the application for modification / vacation, which would be decided on its own merits. The second is that taking back of the respondent in service would not create any equities in favour of the respondent in so far as the modification application is concerned.
3. Both sides will appear before the Tribunal on 27 August 2026 to hear on the modification application. Neither side would be entitled to take an adjournment on the said date.
4. The writ petition is accordingly disposed of.
