1 2026:CGHC:1268 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRCA No. 1975 of 2025 Jaideep Singh S/o Lt. Malkit Singh Aged About 36 Years Resident Of- Shastri Nagar, Near Bhaskar Hospital, Karmchari Nagar, Rampur District- Bareily (U.P.) ... Applicant versus State Of Chhattisgarh Police Station Akaltara, District- Janjgir-Champa (C.G.) ... Respondent For Applicant : Shri Prakash Tiwari, Advocate. For Respondent/State : Shri Priyank Rathi, G.A. Hon'ble Shri Ramesh Sinha , Chief Justice Order on Board 08/01/2026 1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.630/2023 registered at Police Station – Akaltara, District Janjgir-Champa (C.G.) for the offence punishable under Section 306/34 of Ι.P.C. GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.01.09 15:47:29 +0530 2 2. Case of the prosecution, in brief, is that the applicant was employed with ICICI Bank, Bilaspur, since February 2012 and later shifted to HDFC Bank, Rampur (U.P.) on 01.08.2022, where he has been residing with his family after leaving Bilaspur on 21.07.2022. The applicant came to know about the registration of the FIR only through a telephonic call from a former colleague. On 10.11.2023, one Rakesh Kumar Yadav committed suicide at Railway Colony, Akaltara. The deceased’s proposed marriage with Laxmi Yadav, who earlier worked as a maid at the applicant’s rented premises, was called off, following which disputes arose between the deceased and Laxmi Yadav’s family. The deceased later married another woman on 02.01.2023 and was arrested on 08.01.2023 in a rape case registered at Police Station Torwa, Bilaspur. During investigation, a suicide note was recovered wherein the name of the applicant, along with Laxmi Yadav and her family members, was mentioned alleging harassment and threats. 3. Learned counsel for the applicant submits that the applicant is innocent and he has falsely been implicated in this case and all the allegations of involvement of the accused in the incident of the said FIR no. 630/2023 is incorrect as the applicant left for his job in the current organisation back then (ICICI Bank) on 15.07.2022 and left the Bilaspur city (C.G.) on 21.07.2022. He would submit that the applicant left the city of Bilaspur (C.G.) and immediately joined the new organisation (HDFC Bank) in Milak, Rampur (U.P.) on 01.08.2022. He would submit that the applicant has joined his services as a Senior Manager in a new city and organisation after leaving the city of Bilaspur city (C.G.). He would submit that there is no any previous history of any criminal antecedent of the applicant as alleged by the 3 complainant. He would submit that the applicant is permanent resident of - Shastri Nagar, Near Bhaskar Hospital, Karmchari Nagar, Rampur District - Bareily (U.P.) and there is no likelihood of his absconding or tampering with prosecution witnesses, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail and he would submit that there is suicide note in which the applicant has been named, therefore he is not entitled to be released on anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the nature of allegation levelled against the applicant and also considering the fact that investigation and trial are likely to take some time, without commenting anything on the merits of the case, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Jaideep Singh, on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the 4 Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicant shall not involve himself in any offence of similar nature in future. Sd/- (Ramesh Sinha) Chief Justice gouri
