2. Heard Mr. Syed Khader Mastan, learned counsel for the petitioners and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing the respondent/State. Perused the record.
3. The learned counsel for the petitioners would submit that there is no intention on the part of the petitioners to commit the alleged offence. The
learned counsel would further submits that the investigation is might have completed and police filed police custody petition that was allowed and at present the petitioners are in police custody as ordered by the Court. The
4
petitioners undertake to abide by any condition that this Court may impose while granting bail to the petitioners.
4. The learned Assistant Public Prosecutor, strenuously opposed the grant of bail, contending that the investigation is still underway and several material witnesses are yet to be examined. It is submitted that enlargement of the petitioners on bail at this stage would seriously hamper the progress of the investigation and may result in non-cooperation from the petitioners. The prosecution further apprehends that the petitioners, if released, may influence the witnesses, thereby obstructing the course of investigation. It is also urged that there exists a real and imminent risk of the petitioners absconding and evading the due process of law. and it is urged to dismiss the bail petition.
5. On perusal of the record and the statements of witnesses, it appears to be there are specific overt acts attributed to the petitioners/accused Nos.1 to 3 as the petitioners are beat the defacto complainant indiscriminately with hands, legs and stones and also damaged the car of the defacto complainant. The investigation is at a nascent stage, and some more material witnesses are yet to be examined. The petitioners were arrested on 09.01.2026. They have been in judicial custody for the past 20 days only. The statutory period also not completed. There are no merits in the petition. Hence, the criminal petition is dismissed.
