JUSTICE SHAMIMA JAHAN ORDER Date : 28.09.2026 Heard Mr. B Chowdhury, learned Counsel for the petitioner and Mr. KK Das, learned Additional Public Prosecutor for the State. 2. By this application, the petitioner has prayed for bail in connection with Laluk PS Case No. 177/2026 corresponding to GR Case No.799/226 registered under Section 103(1) of BNS, 2023. The FIR in connection with which the petitioner was arrested on 23.08.2026 was lodged by the brother of the deceased stating inter alia that while his brother was sleeping alone in his house, some unknown person entered his house and grievously injured him which resulted in his death. During the investigation of the case, the police arrested the petitioner on the ground that witnesses have stated that the petitioner had assaulted the deceased prior to the occurrence and the reason given was that the petitioner was having extra marital relationship with the wife of the deceased. 3. Mr. KK Das, learned Additional Public Prosecutor for the State prays for calling of the Case Diary. 4. I have heard the learned Counsels for all the parties and upon consideration of the submissions made by the learned Counsel for the parties, more so, in view of the fact that the petitioner was arrested on suspicion, this Court enlarges the petitioner on bail on furnishing of bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of CJM, Lakhimpur, North Lakhimpur under the following conditions: i) the petitioner will appear before the Investigating Officer as and when Page No.# 3/3 called for. ii) the petitioner will not hamper, tamper with the evidence, neither influence the witnesses connected with the case. iii) the petitioner will not leave the place of jurisdiction without the permission of the concerned Court. 5.
