Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record. This application under Section 529 BNSS has been filed seeking direction to the court concerned to conclude and decide Case No. 1139 of 2019 (State of U.P. vs. Madho Prasad and others), under Sections 323 and 504 IPC, arising out of NCR No. 76 of 2018, Police Station Bahariya, District Prayagraj, pending before the court of learned Additional Chief Judicial Magistrate, Court No. 15, Prayagraj, expeditiously within stipulated period. Learned counsel for the applicant submits that cognizance upon the charge sheet has been taken on 22.10.2019, and since then, neither charge has been framed nor a single witness has been examined. It is submitted the present matter is pending since last more than eight years. Looking to the aforesaid circumstances, it is directed that trial pending before the concerned court be concluded expeditiously, as early as possible, within a period of one year, from the date of filing of certified copy of this order, without granting any unnecessary or long adjournments to either of the parties, if there is no legal impediment.
