Memo reads as under: "JOINT MEMO FILED BY THE PETITIONER AND RESPONDENT The petitioner and respondent submits as hereunder: a. It is submitted that above petition is filed by the petitioner challenging the order passed in Crl.Appeal No.840/2016 dated 03.05.2019 passed by LXIII Addl. City Civil and Sessions Judge at Bengaluru and order dated 27.04.2017 passed in CCNO.21060/2016 passed by the 22nd Addl. Chief Judicial Magistrate at Bengaluru. - 4 - HC-KAR NC: 2026:KHC:14121 CRL.RP No. 1268 of 2019 C/W CRL.RP No. 1267 of 2019 b. It is submitted that upon instructions from the petitioner/accused the above matter has been settled for a sum of Rs.90,00,000/- (Rupees Ninety lakhs only) as against Rs.1,25,50,000/- (Rupees one crore twenty five lakh fifty thousand only). The petitioner/accused already deposited a sum of Rs.27,75,000/- (Rupees Twenty seven lakh seventy five thousand only) which is already withdrawn by the respondent/complainant. The petitioner/accused agreed to pay balance amount of Rs.62,25,000/- (Rupees Sixty two lakhs twenty five thousand only) as hereunder: I. A sum of Rs.20,75,000/- (Rupees twenty lakh seventy five thousand only) on or before 31.03.2026. II. A sum of Rs.20,75,000/- (Rupees twenty lakh seventy five thousand only) on or before 31.04.2026. III. A sum of Rs.20,75,000/- (Rupees twenty lakh seventy five thousand only) on or before 31.05.2026. c. The petitioner/accused shall pay the above mentioned amount without fail on or before the above mentioned due dates. In the event of failure to pay any instalment amounts on or before the due dates, the accused shall undergo imprisonment as ordered. d. The aforesaid payments shall be made directly to the bank account of the complainant/respondent i.e., HDFC Bank VV Puram Branch, A/c. No.50100063471058, IFSC Code: HDFC0001749, payee name: Hema Akalwadi. e. It is further submitted that the complainant/respondent undertakes to - 5 - HC-KAR NC: 2026:KHC:14121 CRL.RP No. 1268 of 2019 C/W CRL.RP No. 1267 of 2019 withdraw all the proceedings arising out of CC No.15933/2016 upon complete payment of above mentioned amount. Wherefore, the above petition may be disposed off in terms of the memo filed by the parties in the interest of justice and equity." 3. Learned counsel for respondent has endorsed no objection on the said memo. 4. Placing the memo on record, Revision Petitions stand disposed of. 5. Amount in deposit is ordered to be withdrawn by the complainant under due identification. Further, it is made clear that if the compensation amount as agreed in the memo stands not paid, respondent shall undergo imprisonment as ordered by the Trial Magistrate confirmed by the First Appellate Court.
