JUSTICE V.SUJATHA Writ Petition No: 3659 OF 2026 O R D E R: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeing the following relief: “…to issue a Writ Order or direction particularly, one in the nature of Writ of Mandamus declaring the unexplained inaction of the Respondents in considering and disposing of the detailed representation dated 27.01.2025 submitted by the Petitioner Association on behalf of Village/Grama Ward Sachivalayam employees belonging to Scheduled Castes and Scheduled Tribes, for non-sanctioning of the yearly increments to the petitioners society as per Rule-Andhra Pradesh Sub-Ordinate Services Rules, 1996 and FR Rules is as illegal, arbitrary, unreasonable, unjust and unconstitutional, thereby infringing the fundamental rights guaranteed under Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondents, to grant increments as well to the promotional channel who have completed Five years of service considering the representation of the petitioners society dated 27.01.2025 and to pass such other order or orders…” 2. The petitioner herein is the President of Andhra Pradesh Grama Ward Sachivalayam SC/ST Employees Welfare Association with Registration No.522/2023. 3. The case of the petitioner is that the members of the petitioner’s association were recruited pursuant to Government notifications issued in the year 2019 and were appointed as Village/Grama Ward Sachivalayam employees. As per the recruitment scheme, the employees were subjected to a probation period of two years, during which they were paid only a consolidated remuneration. Under the settled service jurisprudence and the 4 applicable service rules governing Government employees, the period of probation or apprenticeship, once successfully completed, is required to be counted for service benefits, including pay fixation and increments. As the same was not considered by the respondents, the petitioner’s association submitted a comprehensive representation dated 27.01.2025, requesting the respondents to grant two notional increments for the probation period and to introduce a promotion channel or an appropriate advancement mechanism for Village/Grama Ward Sachivalayam employees. As no orders have been passed on the said representation dated 27.01.2025, the present Writ Petition has been filed. 4. As the relief sought in the present Writ Petition is only to the extent of not disposing of the representation dated 27.01.2025 made by the petitioner. Instead of going into the merits of the case, this Court is of opinion to dispose of the Writ Petition, directing Respondent No. 2 to pass appropriate orders, on the representation made by the petitioner on 27.01.2025, within a period of four (4) weeks from the date of receipt of a copy of this order, in accordance with law. 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
