This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 315/2023 registered at Police Station – Sitapur District – Surguja (C.G.) for the offences punishable under Section 407, 420, 120-B of the IPC. 2. Case of the prosecution, in brief, is that an F.I.R has been lodged by the complainant named Anil Kumar Agrawal that in his Rice Mill on VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.01.13 11:42:40 +0530
2 29.10.2023 at about 4 PM truck bearing JH 01 EU 2199 was loaded with Rice Worth Rs. 4,43,800/- which was entrusted to Driver named Rajeshwar Prasad to be transported to M/s Pappu Kumar Khuti (Jharkhand). After 2 days when complainant enquired upon owner of M/S Pappu Khunti it was revealed that Rice loaed truck has not reached to them, thereafter complainant enquired to Present applicant who happens to be transporter of the truck and then present applicant inquired and came to know that Driver has sold the Rice and parked the truck at Yard and owner of truck is Sakir Ansari. Hence the report was lodged. 3. Learned Counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case. He further submits, that the present applicant has neither committed nor participated in any act which may constitute any of the offences mentioned hereinabove that the complainant had entrusted the truck loaded with rice to the driver Rajeshwar Prasad, who sold the same elsewhere and parked the truck in the yard, and this fact was duly informed to the complainant by the applicant himself, but after a lapse of two years, only to recover the alleged loss from the transporter, another driver, namely Mohd.
Hussain, has been arrested merely to pressurize the applicant, especially when the drivers are poor persons; that admittedly there is no evidence on record to show that the applicant was involved in the alleged crime in any manner whatsoever, as he is only a transporter and neither the owner of the vehicle nor the person who sold the rice, and a mere statement of the driver alleging that he dumped the rice on the directions of the transporter does not fasten any liability upon the applicant; that the
3 applicant is a permanent resident of the address mentioned in the cause title and there is no likelihood of his absconding or tampering with the evidence, and he is ready to furnish adequate surety and shall abide by all the directions and conditions that may be imposed by this Hon’ble Court, therefore, he prays for grant of bail. 4. On the other hand, learned State Counsel appearing for the non- applicant/State opposes the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions of the learned counsel for the parties, the nature of the dispute, and the material available in the case diary, this Court, without expressing any opinion on the merits, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Wasim Ansari, on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. 4 (c) he shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
