[2026:RJ-JP:3890] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 421/2026 Banwarilal S/o Shri Jamnaram, R/o Nimli Talai, Tan Nimawas, Police Station Dantaramgarh, District Sikar (Raj.). (At Present Confined In District Jail Sikar). ----Petitioner Versus The State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Babulal Nasuna For Respondent(s) : Mr. Manvendra Singh, PP, Mr. Narendra Singh Hada HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 28/01/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 339/2025 registered at Police Station Danta Ramgarh, District Sikar for the offences under Sections 108 and 61(2) of BNS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that it is alleged against the petitioner that he was continuously harassing and forcing the deceased to enter into relationship with her and on 21.09.2025, deceased- Saroj Devi called Suresh and narrated the conduct of the petitioner. It is also contended that there is no substantive piece of evidence available on record indicating the fact that soon before the death of the deceased, the petitioner instigated the deceased which resulted [2026:RJ-JP:3890] (2 of 3) [CRLMB-421/2026] into her suicidal death. It is also contended that in the FIR, it is alleged that the petitioner in pretext of circulating obscene videos of the deceased Saroj used to threat her, however, no such video was recovered from the petitioner's possession. The accused- petitioner was arrested on 17.10.2025 and after his arrest, charge-sheet has been submitted and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed the bail application. 4. It is contended by learned counsel for the complainant that the petitioner used to harassed the deceased and threatened her to enter into relationship in pretext of circulating the obscene photographs and videos. It is also contended that Suresh in his statement under Section 180 of BNSS has categorically stated that on 21.09.2025 at 10:30 PM, deceased called him and stated that the petitioner was continuously harassing and threatening the deceased to enter into relationship and due to that the deceased committed suicide, therefore, considering the aforesaid facts, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable to express anything upon the merits of the case. The charge-sheet against the accused-petitioner has already been submitted. There is no suicidal note left by the deceased. Apart from the hearsay evidence of Suresh, there is no other incriminating material available on record to the fact that the deceased was subjected to cruelty or harassment by the [2026:RJ-JP:3890] (3 of 3) [CRLMB-421/2026] petitioner, therefore, considering the aforesaid facts, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Banwarilal S/o Shri Jamnaram, in connection with FIR No. 339/2025 registered at Police Station Danta Ramgarh, District Sikar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
