IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
WRIT APPEAL NO: 59 of 2026 Bench Sr.No:-5 [3552]
M/s. Indian Oil Corporation Ltd., and others ...Appellants Vs. M/s Atam Gas Services and others ...Respondents
********** Advocate for Appellants : Mr. Ashok Ram V Advocate(s) for Respondent(s) : Mr. Y V Srinivasan for R.1 & R.2
CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 27th January, 2026
P C :
The present writ appeal has been preferred against the order, dated 06.01.2026 in WP.No.389 of 2026.
2. The learned single Judge by virtue of the order impugned, while granting interim stay, recorded the argument of the petitioners that the action taken by the respondents was in violation of the principles of natural justice and would impact the individual rights and livelihood of the petitioners and that allocating the rights or benefits to a third party without prior knowledge would directly contravene the rights of the petitioners and therefore granted interim stay.
2 HCJ & CGR, J WA_59_2026
3. The appellants (respondent Nos.2 to 5) have not filed any objections to the writ petition and have rushed to this Court by way of the present writ appeal.
4. Although learned counsel for the appellants - Mr. Ashok Ram would submit that there was no question of violation of principles of natural justice inasmuch as the writ petitioners had only been served a show cause notice and that it was open to the petitioners to respond to the same and instead had rushed to file the writ petition, yet, we are of the opinion that it would be appropriate for the appellants to approach the learned single Judge for seeking vacation/modification of the order, after filing their objections.
5. The Writ Appeal is, accordingly, disposed of. No order as to costs.
Registry is directed to list WP.No.389 of 2026 before the learned single Judge having roster on 04.02.2026 by which time the pleadings would be expected to be completed.
Miscellaneous applications pending, if any, shall stand closed.
