GP FOR PANCHAYAT RAJ RURAL DEV The Court made the following: ::ORDER :: The grievance of the petitioner in the writ petition is that respondents 2 to 5 are not taking any action to remove the illegal encroachments on the CC roads laid in Vadrampalle Village & Panchayat, Kanipakam Post, Irala Mandal, Chittoor District, despite the representation dated 01.04.2026. 2. Heard Sri D. Kishore Kumar, learned counsel for the petitioner, Sri Panuku Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj, appeared for respondents 1 to 3 and Ms. Kavitha, learned counsel representing Sri M. Sudhir, learned Standing Counsel, appeared for respondents 4 & 5. 3. The writ petition was filed on 17.04.2026, and on the same day, papers were served on the learned Government Pleader and learned Standing Counsel. 4. The writ petition was listed on 28-4-2026 for admission. Today, when the matter is listed, Sri Panuku Rajesh Kumar, learned Assistant Government Pleader and Ms. Kavitha, learned counsel appearing for Gram Panchayat, submitted that no instructions were furnished by the respondents, despite intimation regarding the filing of a writ petition. 5. It is very unfortunate that, in several writ petitions, the Panchayat Secretaries of the respective Gram Panchayats are hardly responding and sending information to the learned Standing Counsel to enable them to place the same before this Court. 6. Most of the writ petitions, in the Panchayat branch, are being filed complaining of constructions made by the neighbouring individuals, without permission from the Gram Panchayat and the inaction on the part of the officials. Some other writ petitions are complaining of inaction regarding the encroachments. The prompt instructions from the respondent authorities will help the Court in passing appropriate orders. 7. In the case at hand, the relief sought in the main writ petition and in the interlocutory applications are the same i.e. consideration of representation made by the petitioner on 01.04.2026, to remove the illegal encroachments, such as unauthorised constructions, dumping of garbage and construction material on the CC roads laid in Vadrampalle Village & Panchayat. In fact, the petitioner pleaded that such unauthorised acts are causing obstruction to reach his house. Hence, the petitioner made a representation through registered post to respondents 2 to 5 on 02.04.2026 & 04.04.2026, respectively. However, the representations were not attended to. 8. Given the facts and circumstances of the case, since the prayer sought for is innocuous, the Writ Petition is disposed of at the stage of admission with the consent of learned counsel appearing on either side, directing the respondents 2 to 5 or the concerned to consider the representation made by the petitioner dated 01.04.2026 and pass appropriate orders, strictly as per the Rules. The registry is directed to furnish a copy of this order to the learned Principal Secretary to Panchayat Raj – respondent No.1. No order as to costs.
