This is an application under Section 482 of the BNS, 2023 seeking Page No.# 2/3 anticipatory bail in connection with Orang P.S. Case No.33/2026, registered under Sections u/s 112/3(5)/3(6)/3(8)/3(9)/308(6)/308(7) / 317(4)/318(4)/319(2)/351(2)/351(3)/61(2) of BNS, 2023. 3. The allegation in the FIR is that the ejahar was lodged on 05.09.2026 by one namely Jitumani Kalita, SI of Police with the Officer-in-Charge of Orang Police Station bringing allegation inter alia that, the accused persons namely Habijul Islam, Ruful Amin, Habibur Rahman and other persons presently unknown, who, acting together as a group or gang, pursuant to a criminal conspiracy entered into between themselves and with such unknown others, and in furtherance of their - common intention and common object, are carrying on their activities in and about the precincts of Orang Police Station and are, by deception, by the assumption of a false character and by holding out the threat of false criminal prosecution, cheating and extorting money from members of the public and habitually dealing in the proceeds so obtained. Hence the FIR. 4. The case diary has been placed before this Court along with the detailed bail objection submitted by the IO. I have perused the relevant portions of the case diary. There is some progress in the investigation, but the same is still continuing. 5. Supporting the bail objection, the learned Additional P.P. submits that there are direct allegations against the petitioner. It is submitted that the investigation, including examination of witnesses, have revealed the threatening of persons by the accused petitioner with regard to their involvement in the alleged illegal activities. In view of the incriminating materials revealed lending support to the alleged offences, the privilege of anticipatory bail may not be suitable in this case. Page No.# 3/3 6.
