Vijaynath S/o Shri Shankarnath, R/o Beechalwas, Near LIC Office, Kachchi Basti, Dausa, Police Station Sadar, District Dausa (At Present Confined In Sub Jail Phagi District Jaipur). ----Accused-Petitioners Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Vinod Kumar Sharma For Respondent(s) : Mr. Tapesh Agarwal, PP HON'BLE MRS. JUSTICE SANGEETA SHARMA Order 01/04/2026 1. This bail applications has been filed on behalf of the accused- petitioners under Section 483 of BNSS in connection with FIR No. 02/2026 registered at Police Station Phagi, District Jaipur Rural for the offence(s) under Sections 331(4) & 305(a) BNS. 2. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case; charge-sheet has already been filed; the alleged offence(s) is triable by Magistrate. He further submits that similarly situated co-accused [2026:RJ-JP:13559] (2 of 3) [CRLMB-4297/2026] persons Shambhunath and Ajay have been enlarged on bail the Co-ordinate Bench of this Court, vide orders dated 10.03.2026 in S.B. Criminal Misc. Bail Application Nos. 2874/2026 and 3191/2026 respectively; petitioners are behind the bars since 28.01.2026; conclusion of trial may take a long time, and no fruitful purpose would be served by keeping the petitioners behind the bars and, therefore, prays that the petitioners may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor vehemently opposes the bail application and submits that there is one other criminal antecedent against accused-petitioner Kunjbihari Soni @ Jeetu, two other criminal antecedents against accused-petitioner Ajeet and one other criminal antecedent against accused-petitioner Vijaynath. 4. Taking into consideration the overall facts and circumstances of the case; the arguments advanced by learned counsel for the petitioner and considering the fact that charge-sheet has been filed; similarly situated co-accused persons Shambhunath and Ajay have been enlarged on bail the Co-ordinate Bench of this Court; petitioners are behind the bars since 28.01.2026; trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case, deems it just and proper to enlarge the petitioners on bail. 5. Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioners Kunjbihari Soni @ Jeetu S/o Shri Parmanand, Ajeet S/o Shri Mukesh @ Rameshnath and Vijaynath S/o Shri Shankarnath are ordered to be released on bail, provided each of them furnishes a [2026:RJ-JP:13559] (3 of 3) [CRLMB-4297/2026] personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the trial Court, with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 6. It is made clear that the accused-petitioner shall not involve in any other offence(s) during currency of the bail and he shall mark his presence once in a month in the concerned police station. 7. In case of any breach of the aforementioned conditions, the learned Public Prosecutor shall be free to move the application against the accused-petitioner for cancellation of the bail before the concerned Court. 8. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. 9. Office is directed to send a copy of this order to the concerned trial Court through e-mail/fax, for necessary compliance. (SANGEETA SHARMA),J SHIVANI/56
