JUSTICE DEVASHIS BARUAH HONBLE MRS JUSTICE HELEN DAWNGLIANI ORDER Date : 23-09-2026 (D.Baruah,J) 1. Heard Mr. I. Imti Longchar, learned counsel appearing on behalf of the Applicant, Mr. N. Angami, learned Senior Government Advocate appearing on behalf of the Respondent Nos. 1 to 8 and 10 and Mr. Yeka Sumi, learned counsel appearing on behalf of the Respondent No. 9. 2. This is an application for condonation of delay in filing the accompanying Writ Appeal against the Judgment and Order dated 28.04.2023 passed in WP(C)/61/2019. 3. The delay in filing the Appeal against the original Page No.# 3/3 Judgment and Order is 1151 days. However, it is very pertinent to take note of that immediately after pronouncement of the Judgment and Order dated 28.04.2023 passed in WP(C)/61/2019, the Applicant preferred a Review Application before this Court being registered as Review Pet./4/2023. The Review Application thereupon was disposed of by the learned Single Judge on 27.01.2026. 4. We have also taken note of that the Applicant has also provided the reason as to why after the disposal of the Review Petition, the appeal could be filed only on 25.06.2026. This aspect would be apparent from a perusal of Paragraph Nos. 9, 10, 11 and 12 of the application seeking for condonation of delay. 5. We are of the opinion that the grounds so mentioned in the instant application constitute a sufficient cause within the meaning of Section 5 of the Limitation Act, 1963. 6. Considering the above, we condone the delay in preferring the accompanying appeal against the Judgment and Order dated 28.04.2023 passed in WP(C)/61/2019. 7. Interlocutory Application stands disposed of. JUDGE JUDGE Comparing Assistant
