Heard the learned counsel for the petitioners and the learned Assistant Government Pleader. 3. The grievance of the petitioners, who are nine in number, is that they intended to convert their lands into fish ponds. However, some intruders have been obstructing them from carrying out the above activity. In spite of several representations given to the respondents, they have not taken any action. 4. Indeed, if the immovable property of private individuals is interfered with, or if the peaceful possession and enjoyment of the immovable property of private individuals is infringed, the petitioners, being private individuals, if their right to use and enjoyment of the property is being infringed by any person, are entitled to file an appropriate suit seeking 4 Dr. YLR, J W.P.No.1717 of 2026 Dated 21.01.2026 permanent injunction, while maintaining an interlocutory application seeking grant of ad-interim ex-parte injunction. It appears that the petitioners have not invoked a civil remedy. The police have no role to play in civil disputes with respect to the immovable property of the petitioners. 5. Considering the facts and circumstances of the case, the Writ Petition is disposed of, granting liberty to the petitioners to approach the Competent Civil Court for appropriate remedy against the alleged intruders. 6. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
