Heard Mr. D. Chutia, learned Counsel for the petitioner and Mr. KK Das, learned Additional Public Prosecutor for the State.
2. By this application, the petitioner has prayed for bail in connection with Silapathar PS Case No. 154/2026 registered under Section 64/75/329(4)/117(2)/296/3(5) of BNS, 2023. The FIR in connection with which the petitioner was arrested on 21.07.2026 was lodged by the victim herself stating inter alia that on 18.07.2026 at around 11:00 am, the petitioner entered into her house in absence of her husband and committed rape upon her. She also stated that on the next day, the wife of the petitioner came and assaulted her. The police on completion of the investigation has submitted charge sheet on 01.09.2026 arraying the petitioner as the accused person.
3. Mr. KK Das, learned Additional Public Prosecutor for the State submits that the victim herself has alleged that it was the petitioner, who had raped her. He also prays for calling of the Trial Court Records.
4. I have heard the learned Counsels for all the parties and upon
consideration of the submissions made by the learned Counsel for the parties, more so, in view of the fact that the petitioner has been inside the jail for 70 days and also due to the fact that the incident had taken place in the day time, this Court enlarges the petitioner on bail on furnishing of bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of CJM, Dhemaji under the following conditions: i) the petitioner will appear before the Trial Court as and when called for.
Page No.# 3/3 ii) the petitioner will not hamper, tamper with the evidence, neither influence the witnesses connected with the case. iii) the petitioner will not leave the place of jurisdiction without the permission of the concerned Court.
