Heard Mr. S. Hazarika, learned counsel for the petitioners. Also heard Mr. M.P. Goswami, learned Additional Public Prosecutor for the State. 2. This is an application under Section 482 of the BNSS, 2023 whereby the petitioners, namely, 1. Sri Ganapati Saloi, 2. Rakesh Dutta and 3. Nishant Kalita are seeking Anticipatory Bail apprehending arrest in connection with an FIR, which is registered as Rangia Police Case No. 163/2026 registered under Sections 126(2)/127(2)/196(1)(b)/115(2)/296(a)/3(5) of BNS, 2023. 3. The allegation against the petitioners is that they wrongfully restrained the persons named in the FIR and humiliated them by asking them to lower their trousers to determine their religious identity. 4. The case diary has been received earlier and the same sent for updatation. 5. The learned counsel for the petitioner draws attention to the settlement arrived in connection with the alleged incident. The copy of the same has been annexed in this petition and peursed the same. He also points out that except section 196(1)(b) BNS, the other sections are bailable. Section 196(1)(b) criminalizes the act of creating enmity between communities. 6. The learned prosecution submits that up-to-date case diary may be called for. Page No.# 3/3
7. However, in the facts and circumstances, I propose to dispose of the bail petition and I do not deem it necessary to cancel the interim bail. Accordingly, the interim bail granted to the petitioners vide order dated 14.08.2026 is hereby made absolute subject to the conditions that the petitioners shall cooperate with the process of law and shall not commit any activities detrimental to social harmony. 8.
