1. Petitioner has filed this writ petition seeking following reliefs:-
“10.1)That, this Hon’ble Court may kindly be pleased to allow the petition and direct the respondent authorities to frame the Promotion Rules for Psychiatric Social Worker (PSW) working in the Mental Hospital Sendri Bilaspur (CG). 10.2) That, this Hon’ble Court may kindly be pleased to direct to respondent authorities to give the promotion to the petitioner as Class-I Psychologist. 10.3) That, this Hon’ble Court may kindly be pleased to sop the process of interview for the post of Clinical Psychologist and also give the chance to the petitioner in respect of advertisement dated 22.04.2025 issued by the Chhattisgarh Public Commission. 10.4) That, this Hon’ble Court may kindly be declared that no promotion rule for PSW is a violation of article 14, 16 and 21 of Constitution of India. 10.5) Any other relief which this Hon’ble Court may deem fit and proper also kindly be granted to the petitioner, in the interest of justice.”
2. Learned counsel for petitioner submits that since 2013 petitioner is working as Psychiatric Social Worker (PSW) in State Mental Hospital Sendri, Bilaspur. However, even after
3 lapse of more than 12 years, petitioner has not given promotion as there is no promotional avenues under the Rules available. Hence, respondent authorities be directed to frame rules in this regard. 3. Learned State Counsel opposing submission of learned counsel for petitioner, would submit that considering length of service of petitioner, he was extended benefit of 1st time bound pay-scale vide order dated 29.9.2023. If petitioner is having grievance that he has not been promoted as there is no promotional avenue, he can submit representation before the authority concerned for redressal of his grievance. 4. Learned counsel for respondent No.2 adopts submission of learned State Counsel. He, however, submits that petitioner has not submitted any representation before respondent No.1 for redressal of his grievance till date. 5. Heard learned counsel for respective parties and perused the documents annexed with writ petition. 6. Main grievance of petitioner in this writ petition is that there is no promotional avenues for the employees like petitioner as no rule has been framed in this regard. However, petitioner has been paid first time bound pay-scale considering that petitioner is continuously posted at one place for about 10 years. 4

Job to frame rules governing service condition of a government employee is of the State Government. Petitioner has not approached the authorities concerned for redressal of his grievance as raised in this writ petition. 8. Considering entirety of the facts and circumstances of the case, nature of grievance raised in this writ petition, without entering into merits of claim of petitioner, writ petition is
disposed of at this stage permitting petitioner to submit comprehensive representation before respondent No.1 for redressal of his grievance as projected in this petition, raising all the grounds as raised in this writ petition along with all other relevant documents. On receipt of such representation, respondent No.1 shall consider and decide the same in accordance with law expeditiously.
